Many scholars claim that Abbé Sieyès (1748–1836) was the first to deploy the concept of a pouvoir constituant (constituent power) as the power that establishes a constitutional order under which the ordinary powers of government are conferred. Others find the substance of the theory to have been articulated by earlier figures such as Jean-Jacques Rousseau, whilst conceding that the terminology of pouvoir constituant was not used until Sieyès. What no one has observed until now is that the Scottish Presbyterian divine, (...) Samuel Rutherford (1600–1661), can lay claim to being the first to explicitly use the language of constituent power and to develop a theory of the grounds of constitutional government expressly in those terms. Rutherford argues that “the constituent is above that which is constituted,” and thus draws a clear distinction between constituent and constituted power. Furthermore, he vests the former ultimately in the people while the King possesses only constituted power. Rutherford presented a theory of constituent power that had all the essential elements of the theory of pouvour constituant we find in Sieyès, albeit a theory embedded in a political and intellectual context as different from that of Sieyès as his is from our own. The famous Epistola Luciferi, written in late 1351 or early 1352, caused quite a stir in the Avignon of Pope Clement vi, quickly became a medieval best-seller, and thereafter remained topical, being copied and printed down to the present day. Traditionally ascribed to Nicole Oresme or Henry of Langenstein, the letter was attributed to the Cistercian Pierre Ceffons by Damasus Trapp in 1957. Trapp merely took Ceffons’ authorship for granted, however, and in the most thorough study of the Epistola Luciferi (...) and of the entire genre of Devil’s letters, her 1982 PhD dissertation, Helen C. Feng rejected the attribution. Presenting codices and works of Ceffons of which Trapp was unaware, this article argues in favor of Ceffons’ responsibility for the Epistola Luciferi, while offering a new critical edition of the letter, an English translation, and a supplemental list of manuscripts and editions. Graham Harman describes the allure of art as the tension and fusion of a real object to sensual qualities so that it makes it seem that the inwardness of reality is opened to us. Yet real objects are withdrawn; how are we aware of their fusion? Since Harman’s ontology mandates that contact between real objects occurs only through sensual objects, this essay explores the idea that art’s allure must be a tension between sensual objects that draw the experiencer to believe, (...) or alieve, they are in contact with the withdrawn real. By looking at the examples in representational painting and sleight of hand magic, we see that ontographic art objects use at least four, carefully separated sensual objects to produce their aesthetic effect. The conclusion summarises allure as a sensual object process, speculates on art’s dialetheic confusion of sensual and real objects giving an enduring allure to idealism, and notes potential motifs of an infra-realist resistance. This paper examines explore the issues of intergenerational equity raised by climate change. A number of different reasons have been suggested as to why current generations may legitimately favor devoting resources to contemporaries rather than to future generations. These - either individually or jointly - challenge the case for combating climate change. In this paper, I distinguish between three different kinds of reason for favoring contemporaries. I argue that none of these arguments is persuasive. My answer in each case appeals (...) to the concept of human rights. It maintains that a human rights-centered perspective to climate change enables us to address each of these reasons. (shrink)

In this paper I use philosophical accounts on the relationship between trust and knowledge in science to apprehend this relationship on the Web. I argue that trust and knowledge are fundamentally entangled in our epistemic practices. Yet despite this fundamental entanglement, we do not trust blindly. Instead we make use of knowledge to rationally place or withdraw trust. We use knowledge about the sources of epistemic content as well as general background knowledge to assess epistemic claims. Hence, although we may (...) have a default to trust, we remain and should remain epistemically vigilant; we look out and need to look out for signs of insincerity and dishonesty in our attempts to know. A fundamental requirement for such vigilance is transparency: in order to critically assess epistemic agents, content and processes, we need to be able to access and address them. On the Web, this request for transparency becomes particularly pressing if (a) trust is placed in unknown human epistemic agents and (b) if it is placed in non-human agents, such as algorithms. I give examples of the entanglement between knowledge and trust on the Web and draw conclusions about the forms of transparency needed in such systems to support epistemically vigilant behaviour, which empowers users to become responsible and accountable knowers. The task of axiomatizing physical theories has attracted, in recent years, some interest among both empirical scientists and logicians. However, the axiomatizations produced by either one of these two groups seldom appear satisfactory to the members of the other. It is the purpose of this paper to develop an approach that will satisfy the criteria of both, hence permit us to construct axiomatizations that will meet simultaneously the standards and needs of logicians and of empirical scientists.

For each k 1, let Γk be the countable universal homogeneous k-hypergraph. In this paper, we shall classify the closed permutation groups G such that Aut G Sym. In particular, we shall show that there exist only finitely many such groups G for each k 1. We shall also show that each of the associated reducts of Γk is homogeneous with respect to a finite relational language.

This paper examines what agents should do when others fail to comply with their responsibilities to prevent dangerous climate change. It distinguishes between six different possible responses to noncompliance. These include what I term (1) 'target modification' (watering down the extent to which we seek to prevent climate change), (2) ‘responsibility reallocation’ (reassigning responsibilities to other duty bearers), (3) ‘burden shifting I’ (allowing duty bearers to implement policies which impose unjust burdens on others, (4) 'burden shifting II’ (allowing some to (...) protect peoples rights in ways which impose otherwise unjustified burdens on the duty bearers, (5) 'compromising moral ideals' (permitting agents to compromise non-justice ideals that they are otherwise bound by); and (6) ‘promoting compliance (implementing policies and creating institutions which reduce noncompliance). It concludes by outlining a methodological framework for evaluating these options, and by setting out my tentative and provisional evaluation of which responses are the least bad. (shrink)

We explore the question of whether sustained rational disagreement is possible from a broadly Bayesian perspective. The setting is one where agents update on the same information, with special consideration being given to the case of uncertain information. The classical merging of opinions theorem of Blackwell and Dubins shows when updated beliefs come and stay closer for Bayesian conditioning. We extend this result to a type of Jeffrey conditioning where agents update on evidence that is uncertain but solid (hard Jeffrey (...) shifts). However, merging of beliefs does not generally hold for Jeffrey conditioning on evidence that is fluid (soft Jeffrey shifts, Field shifts). Several theorems on the asymptotic behavior of subjective probabilities are proven. Taken together they show that while a consensus nearly always emerges in important special cases, sustained rational disagreement can be expected in many other situations. (shrink)

Boghossian's discrimination argument for the incompatibility of externalism and a priori self-knowledge presupposes the relevant-alternatives account of knowledge, more precisely, the claim that the ability to rule out relevant alternatives is a necessary condition for knowledge. In the first two sections of this essay, I object to Boghossian's argument by showing that the standard way of supporting the claim just mentioned, namely with recourse to Goldman's famous barn example, will not convince a rational externalist who knows the relevant facts. In (...) section three, a second challenge to the discrimination argument is developed. First, a descriptive variant of Goldman's barn example is distinguished from a demonstrative variant of this scenario. Then, it is argued that the fact that Goldman's protagonist does not have knowledge in the demonstrative variant cannot be explained by the claim that the ability to rule out relevant alternatives is necessary for knowledge. From this it is concluded that it is not possible to substantiate the claim just mentioned with recourse to Goldman's barn example. The upshot of the discussion in sections one through three is that one cannot argue for the incompatibility of externalism and a priori self-knowledge by drawing on the claim that the ability to rule out relevant alternatives is required for knowledge. In the final section of the article, it is shown that one can furthermore not argue for the incompatibility thesis by invoking the contention that so-called global reliability is necessary for knowledge. Rather than defend each instance of problem suggested by Williams, what I propose to do is to respond by making two clarificatory points: first, I rule out two ways of understanding mathematical problems that might be clouding the water; and then, second, I further characterise how Deleuze thinks some mathematical problems, two in particular, are not just examples of mathematical problems, but provide mathematical models for what a mathematical problem in general can be understood to be. This is important because (...) it is how mathematical problems can be modelled in mathematics that provides Deleuze with a model for how problems can be modelled in other discourses. This will then get to the bottom of what is at stake in my approach to Deleuze and to Deleuze studies in general. (shrink)

Unconscious stimuli can influence participants’ motor behavior but also more complex mental processes. Recent research has gradually extended the limits of effects of unconscious stimuli. One field of research where such limits have been proposed is spatial cueing, where exogenous automatic shifts of attention have been distinguished from endogenous controlled processes which govern voluntary shifts of attention. Previous evidence suggests unconscious effects on mechanisms of exogenous shifts of attention. Here, we applied a cue-priming paradigm to a spatial cueing task with (...) arbitrary cues by centrally presenting a masked symmetrical prime before every cue stimulus. We found priming effects on response times in target discrimination tasks with the typical dynamic of cue-priming effects indicating that central symmetrical stimuli which have been associated with endogenous orienting can modulate shifts of spatial attention even when they are masked. Prime–Cue Congruency effects of perceptual dissimilar prime and cue stimuli suggest that these effects cannot be entirely reduced to perceptual repetition priming of cue processing. In addition, priming effects did not differ between participants with good and poor prime recognition performance consistent with the view that unconscious stimulus features have access to processes of endogenous shifts of attention. Causal queries about singular cases, which inquire whether specific events were causally connected, are prevalent in daily life and important in professional disciplines such as the law, medicine, or engineering. Because causal links cannot be directly observed, singular causation judgments require an assessment of whether a co‐occurrence of two events c and e was causal or simply coincidental. How can this decision be made? Building on previous work by Cheng and Novick (2005) and Stephan and Waldmann (2018), we propose a (...) computational model that combines information about the causal strengths of the potential causes with information about their temporal relations to derive answers to singular causation queries. The relative causal strengths of the potential cause factors are relevant because weak causes are more likely to fail to generate effects than strong causes. But even a strong cause factor does not necessarily need to be causal in a singular case because it could have been preempted by an alternative cause. We here show how information about causal strength and about two different temporal parameters, the potential causes' onset times and their causal latencies, can be formalized and integrated into a computational account of singular causation. Four experiments are presented in which we tested the validity of the model. The results showed that people integrate the different types of information as predicted by the new model. (shrink)

In this article we study how reported speech markers are used as procedural resources in a laboratory based parapsychology experiment to investigate forms of anomalous communication, such as extrasensory perception. In particular, we focus on how specific activities in a key part of the experiment are mediated by the use of `you said' formulations which project that whatever is said next is a paraphrase or a verbatim report of what the recipient had said earlier. We identify two uses of reported (...) speech markers. First, they are used in utterances that initiate some form of repair, such as correction or clarification. Second, they cluster in sequential locations that mark, after a temporary suspension, the resumption of key activities in the experiment. In this we hope to contribute to the study of the institutional properties of reported speech. We conclude by discussing the ways in which broader cultural understandings of the inferential force of `you said' formulations inform their use in this institutional setting, and reflecting on the significance of these findings for parapsychological investigation of anomalous communication in this setting. It should be hardly surprising to discover that eighteenth-century European perspectives of other cultures were shaped to a large extent by concerns internal to European political life. Objective or unprejudiced accounts of non-European cultures are rarely found among travellers, missionaries, and philosophers of the time. While the insights of Enlightenment political thinkers on the non-European world may shed little light on the cultures being commented upon, they are useful for assessing the nature of the Enlightenment's engagement with cultural traditions external (...) to Europe. In particular, Enlightenment conceptions of China were extremely varied and reflective of the debates between Enlightenment thinkers, especially on the proper relation between religion and politics. I shall argue that Montesquieu's account of Confucianism in The Spirit of the Laws (De l’esprit des lois, first published in 1748) was in part influenced by his critique of Bayle's position on the role of religion in society as expounded in his Various Thoughts on the Comet (Pensées diverses sur la comète, published in 1682). While Montesquieu's account and assessment of Chinese thought and culture are “Eurocentric,” his evaluation of Confucianism nevertheless arises from a considered philosophical position on religion and politics. Exemptions from laws of general application are sometimes granted on the basis of an individual’s unwillingness to comply with the law. Most such volitional exemptions involve a conflict between the law and the demands of an individual’s religious or secular moral convictions. I argue here that a limited number of volitional exemptions can be justified on the basis of a futility principle. When otherwise morally permissible penalties for violating the law cannot be expected to induce the compliance of an intransigent (...) minority, the penalties are futile, and the state has some principled reason to exempt the minority from the law’s requirements. Since the futility principle only applies to some cases of conscientious objection, it differs in important ways from justifications grounded in a general entitlement to religious or moral exemptions.
